Updated Rules for Canada’s Spousal Open Work Permits

As of March 19, 2024, Canada has implemented significant changes to the eligibility requirements for Spousal Open Work Permits (SOWP). These updates, primarily affect spouses of international students, and modify who can obtain work permits based on their partner’s level of education. Understanding these changes is crucial for couples planning their future in Canada, ensuring they align their educational and professional plans with the new regulations.

Who is Affected by the New SOWP Rules?

Under the new rules, only spouses of international students enrolled in master’s or doctoral degree programs at recognized universities or polytechnic institutions are eligible to apply for an SOWP. This is a shift from the previous guidelines, which permitted spouses of students in undergraduate and college programs to also qualify for work permits.

List of Eligible Programs – Open Work Permit

Despite the restrictions, there is a silver lining for spouses of students pursuing undergraduate degrees—if those degrees are in specific professional fields. The eligibility now extends to partners of students enrolled in the following professional degree programs:

  • Those studying in a master’s or doctoral degree program;
  • Those participating in an eligible pilot program; or
  • Those studying in one of the following professional degree programs at a university:
    • Doctor of Dental Surgery (DDS, DMD)
    • Bachelor of Law or Juris Doctor (LLB, JD, BCL)
    • Doctor of Medicine (MD)
    • Doctor of Optometry (OD)
    • Pharmacy (PharmD, BS, BSc, BPharm)
    • Doctor of Veterinary Medicine (DVM)
    • Bachelor of Science in Nursing (BScN, BSN, BNSc)
    • Bachelor of Nursing Science (BNSc)
    • Bachelor of Nursing (BN)
    • Bachelor of Education (B.Ed.)
    • Bachelor of Engineering (B.Eng., BE, BASc)

Document Requirements for SWOP Application

If you fall under one of these exceptions, you will need to provide substantial proof to support your application. Required documents include one of the following:

  • A valid Acceptance Letter (LOA) from a Designated Learning Institution (DLI) indicating the student’s enrollment in an eligible professional degree program.
  • Proof of enrollment letter from the student’s DLI confirming their current student status.
  • Transcripts from the student’s ongoing educational program.

Implications for Current Applicants and SOWP Holders

For those who have already submitted their Spousal Open Work Permit applications before the March 19, 2024, cutoff, there is no need to worry about the new changes. Your application will be processed under the rules that were in place at the time of submission. This ensures that your eligibility is preserved, provided that:

  • The international student has a valid study permit.
  • They are enrolled full-time in an approved institution and are pursuing a program that will make them eligible for a post-graduation work permit (PGWP).
  • The institution falls under the categories of public post-secondary schools, such as universities or colleges, including CEGEPs in Quebec, or private college-level schools in Quebec authorized to confer degrees.

This also applies to current SOWP holders seeking to extend their permits. As long as these conditions are met, and your application or extension request was submitted before the rule changes, your eligibility for an SOWP remains intact.
